Terms and Conditions for Web Hosting, Web Design and Domain Name Registration

General Terms

• We do not allow Adult, Warez, illegal MP3 Sites or IRC Bots.
• You may not store more data in your account than your allotted virtual server space.
• Your virtual server (inc FTP and Telnet access) is for your personal use only
• You must not divulge the password to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people.

• Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your virtual server.

• You may not run server processes (eg. talkers/IRC Bots) from your virtual server.
• We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.
• When your account is closed, all files (including web pages, etc.) will be deleted.
• We reserve the right to cancel your account at any time without notice.
• To protect your privacy we never distribute your name or e-mail address to any third parties.
• Users must not participate in any form of un-solicited bulk e-mailing or spam.
• By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.
• By and on payment it means you agree to the Hosting terms and conditions but your statutory rights are not affected. Ontanet reserves the right to change or modify any of these terms or conditions at any time. Should clarification of any of the above be required please contact Ontanet.

Web pages

• Commercial use of web and ftp space is permitted.
• You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law.
• You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).
• We reserve the right to remove material deemed inappropriate from your web pages, without prior notice. We do not allow adult, warez or illegal MP3 web sites on their servers.
• By and on payment it means you agree to these terms and conditions but your statutory rights are not affected. Ontanet reserves the right to change or modify any of these terms or conditions at any time. Should clarification of any of the above be required please contact Ontanet.

Domain names

• Ontanet does not guarantee that any domain names registered will be free and clear of intellectual property rights and/or claims by third parties (including, without limitation, rights and/or claims in relation to registered and unregistered trade marks).
• Payment acknowledges that you accept the terms and conditions for any domain names registered.
  All domain names registered by Ontanet on the customers' behalf may subsequently be challenged and/or cancelled by persons other than Ontanet
• Ontanet will be registered as the Administrative and Billing Contact for any domain name registered, or held on behalf of, the Customer.
• Ontanet will endeavour to meet any dates agreed for the obtaining of the names and domains requested by the Customer, but such date shall be an estimate only and Ontanet accepts no liability for failure to meet such date or dates.
• Any domain transfers from Ontanet will incur an admin charge of £10:00 + VAT per domain.

  Web Design

• Ontanet requires a 50% deposit on all webdesigns before undertaking any work. After work commences this is non-refundable. Balance of invoice on completion of work.
• Payment acknowledges that you accept the terms and conditions for any website design work undertaken
• Ontanet will hold intellectual copyright of any material, including any source code and original images created for the client until payment of the final invoice. At this time we will transfer this intellectual copyright to the client
• In situations where the client provides images, text, animations or any other content for their website they are legally responsible for ensuring that this material does not infringe any copyright. Certain images provided by Ontanet in the construction of the website may have been purchased under licence from stock image suppliers. These images are generally only licensed for use on a single website and may not be used in publicity material. The website owner is legally responsible for ensuring that this does not happen. If you wish to use any images from the site for other purposes please contact us for clarification.
• Should the Client Web site be installed on a third-party server, Ontanet must be granted temporary read/write access to the Customer's storage directories, and those directories must be accessible via FTP. Depending on the specific nature of the project, other resources might also need to be configured on the server.
• Should the client wish to cancel at any point during the design process they shall remain liable for the work that has taken place and shall be invoiced accordingly.
• The website is provided to and accepted by the client as a fully functioning, completed work. Ontanet is not responsible for future support. This support can normally be provided upon request and for an agreed fee. No guarantee of future support is given unless an ongoing support package is negotiated.
• Unfortunately malicious software, spyware, viruses and website hacking are facts of life on today’s Internet. It is highly unlikely that these will affect your website, and Ontanet will endeavour to protect it from this as much as we can during its creation.  We cannot be held responsible for problems that develop on completed sites as a result of illegal activity.
• Ontanet design websites in accordance with the client’s specifications. It is the client’s responsibility to ensure that the website and its content comply within the laws of the country where its business takes place. We cannot accept responsibility for any failure to comply with regulations related to accessibility, selling online or those related to a specific business or trade. We can research this on the client’s behalf upon request, but in any business where complex compliance issues exist we recommend that the client takes legal advice from their company lawyer.
• Termination of services by the Customer must be requested in a written notice and will be effective on receipt of such notice. E-mail or telephone requests for termination of services will not be honoured until and unless confirmed in writing. The Customer will be invoiced for design work completed to the date of first notice of cancellation for payment in full within thirty (30) days.
• Ontanet will use all reasonable endeavor to meet quoted completion dates. However, time is not the essence of the Contract and Ontanet will not be liable in cases of late reporting, however caused, nor shall lateness be deemed to be a breach of Contract or an act of negligence.
• Except as directed by either party, required by law, or provided in this clause, neither party or their employees or subcontractors will at any time during the Webdesign Project or for a period of three (3) years after completion and or any termination of the Webdesign, disclose any Confidential Information to any person or entity, or permit any person or entity to examine and/or make copies of any files and or any documents prepared by Ontanet or that come into either Ontanets possession or under the Ontanets control that relate to Confidential Information, and that upon completion and or termination of the Website design, both parties will destroy and or return to the other all materials that contain or relate to the other party's Confidential Information.
